Terms of Use

1. Who you are dealing with

This site is operated as Nightjar Games. You can reach a human at support@nightjar.games.

Payments are handled by Polar Software Inc., who act as the merchant of record. That means Polar is the seller for the transaction itself: they take the payment, issue the invoice, handle any sales tax or VAT, and their own terms apply to the payment. We never see or store your card details.

2. Using the site

No account, no sign-up, no password. Every puzzle is generated from its date, so everyone gets the same puzzle on the same day, and a new set appears at midnight UTC.

Please do not attack the site, scrape it at volume, or try to break other people's use of it. Beyond that, play however you like — there is no cheating rule here, because there is nobody to cheat.

3. The archive pass

The pass costs USD 10 per year. Polar will show the price in your local currency at checkout, and that converted amount is what you pay.

It gets you access to past days for as long as the pass is current. It is not:

Your key

When you buy, Polar issues you a licence key. That key is your access — there is no account to log in to. Use it on as many of your own devices as you like.

If you lose it, you can always see it again in Polar's customer portal by signing in with the email address you paid with. We can look it up for you too, but the portal is faster.

The key is for you. Publishing it, selling it, or handing it round at scale is the one thing that will get a pass cancelled without a refund. Lending it to someone in your house is not what that means.

Renewal and cancellation

The pass renews once a year until you cancel it. You can cancel any time from Polar's customer portal, and cancelling is not the same as losing access — you keep the archive until the end of the period you have already paid for, and it simply does not renew after that.

4. Refunds

Within 7 days of a payment: a full refund, no questions asked. Email support@nightjar.games or raise it through Polar. Refunds are processed by Polar, so the money goes back the way it came, usually within a few working days.

After 7 days a payment is generally not refundable. If a renewal was unintended and the archive has not been used since, get in touch and it will be considered.

This is our own policy and sits alongside your rights under consumer law rather than replacing them. If the law where you live gives you a longer cooling-off period, that period applies. Polar's refund policy as merchant of record also continues to apply.

5. Availability

Games may be added, changed, or retired, and the site may be unavailable at times. It is provided without a guarantee of uptime or of continued availability of any particular feature.

6. Liability

The site is provided as it is. To the extent the law allows, our total liability to you is limited to what you have paid us in the twelve months before the claim — which for most people is nothing, and for the rest is about ten dollars.

Nothing here limits liability for anything that cannot lawfully be limited, including fraud.

7. Changes to these terms

These terms may change. The date at the top says when they last did. If a change materially affects a pass you have already paid for, the terms you bought under continue to apply for the rest of that period.

8. Law

These terms are governed by the law of the Republic of South Africa. If you bought as a consumer elsewhere, you keep the protections of your own country's law.
