This notice explains how Nightjar Games handles personal information. The site has no accounts, so there is very little of it.

Who is responsible

Nightjar Games operates nightjar.games and is the responsible party for the information described here. Contact: support@nightjar.games.

What is collected, and why

Playing the games

Nothing is collected. Your progress is stored in your own browser and is not transmitted to us.

Analytics

The site uses a cookieless analytics service to count page views and see which puzzles get played. It sets no cookie and stores nothing on your device. Each visit is recorded with the page, the page that referred you, your approximate location and your device and browser type, worked out from the request itself rather than from an identifier that follows you around. There is no profile, no tracking across sites, and no advertising use. The provider can be named on request.

Purchases

Purchases are processed by Polar Software Inc. as merchant of record. Polar collects the information needed to take payment and issue an invoice, including your name, email address and billing details, under their privacy policy. We do not receive or store payment card details.

To provide access to the archive we retain a record of the licence key issued, the date the pass runs to, and related identifiers from Polar. This record does not include your name, email address or billing details.

Security

IP addresses are processed briefly to prevent abuse of the licence key form, and by our hosting provider in the ordinary course of serving the site.

Legal basis

Where the GDPR applies: purchase records are processed to perform a contract with you; security processing rests on legitimate interests; and analytics also rests on legitimate interests, being cookieless and building no profile. Where POPIA applies, processing is on the corresponding lawful bases.

Who information is shared with

Only the service providers needed to run the site: payment processing, analytics and hosting. These providers can be named on request. Information is not sold, and is not shared for advertising. It may be disclosed where required by law.

These providers operate outside South Africa, so information may be processed abroad under their respective safeguards.

Retention

Purchase records are kept for the duration of the pass and for as long as needed afterwards to answer support and meet record-keeping obligations. Abuse-prevention data is kept briefly. Analytics is aggregated and retained according to the provider's settings. Data held in your browser stays until you clear it.

Your rights

Subject to applicable law, you may request access to the personal information held about you, ask for it to be corrected or deleted, object to certain processing, and lodge a complaint with your data protection authority. In South Africa this is the Information Regulator.

In practice there is little to give. There are no accounts, and we hold no name, email address or billing details. What exists is the record attached to a purchase, and abuse-prevention data associated with an IP address rather than with a person. Analytics is not tied to a person or a browser at all, so there is nothing in it to look up. Information that identifies you by name or email is held by Polar and is available through their customer portal.

Requests can be sent to support@nightjar.games. Deleting a purchase record ends the access it provides.

Cookies

This site sets no cookies at all. Analytics is cookieless, so there is nothing to consent to and no banner to dismiss.

The site does keep two things in your browser's own storage: your puzzle progress, so a half-finished board survives a reload, and — once you have bought a pass — the licence key and the token that unlocks the archive on that device. Both are there because the site would not work without them, neither is sent anywhere to identify you, and clearing your browser storage removes both. Clearing the key means redeeming it again, which costs nothing but typing.

Children

The site is not directed at children and we do not knowingly collect personal information from them.
